Do you need an attorney for eminent domain?


Eminent domain or a “taking,” as it’s also called, is a power vested in the state (or federal government) to appropriate private property for public or other permissible use. The government, however, must pay the landowner “just compensation” for the land.

The battleground in eminent domain cases almost always centers on how much the land is worth, i.e, how much money the state should pay the landowner. Often, the land taken by the state is either vacant or underutilized, and the attorney’s objective is to show the development potential of the land.

New transponders are free and require a $20 deposit as initial payment, which can be automatically replenished with credit card or debit card. Up to four transponders can be atttached to an individual account.

E-Z Pass is accepted in Maine, New Hampshire, Rhode Island, New York, Pennsylvania, New Jersey, Delaware, Maryland, North Carolina, Virginia, West Virginia, Ohio, Indiana, Illinois.

Transponders should be installed on the inside of a vehicle windshield, just to the right of the rearview mirror support and below any tinting.

DOES YOUR HOUSE HAVE GOOD BONES? BY SUSAN MOGREN

Over the years, clients and potential homebuyers turn to realtors for help to determin if a particular house has the potential to meet their needs. They want to know if the house has “good bones”. We’ve all heard the term, but what does it actually mean?

 

My definition is a house that has the basic framework necessary to meet the needs and desire of my clients.  The key features are: solid and well built, good flow, open space, character, and natural light.

 

Quality construction – A house with good bones is well-built. I “walk” a building looking for fundamental structural problems. How does it feel? Does it bounce or list, or does it “feel” solid? Are things tight? When I go to the basement, I look along the bottoms of the floor joists. Do they seem to be in a flat plane or do they sag in the middle of their span? Are the joists notched into the sill or resting on their full depth? Can you see cracks between the ends and the sill, or are they still tight? When looking down along the foundation wall, does it look plumb or is it listing outward? When outside the building and stepping back looking at it, do the walls have bows or are they straight? Does the house lean to one side or the other? Does the roof or the front porch sag? Are there sways to the roof or is it in one plane?

 

Solid infrastructure – It’s relatively simple to replace aging roofing shingles or update plumbing fixtures, but it is far more complicated if the basic infrastructure of the home is lacking. If the foundation, roof, heating, plumbing and electrical systems are in good shape, renovations become much easier. Consult your contractor.

 

Good floor plan – Is there good flow between frequently used rooms? Are rooms arranged logically?  Look at how traffic travels through the house as a whole. You can renovate to make particular rooms more livable, but it is far more costly and complex to make fundamental changes because the entire home’s floor plan just does not work.
If a floor plan feels awkward, try to envision the space with walls moved, or taken down entirely. Are the rooms disjointed and tiny? Can you create a sense of a sense of spaciousness without changing the footprint of the house? Consult your contractor.

 

Well-proportioned rooms – Are the home’s rooms a useful size and shape, or can they be easily changed? It is often possible to move walls and open up spaces relatively easily. Removing walls, adding a beam and creating an open a floor plan can make a separate kitchen, dining room and living room into a great entertainment area or family space. On the other hand, sometimes there are fundamental problems that are not easy to correct. Consult your contractor.

 

Character — Houses with good bones have a personality. They don’t look like they were stamped out cookie cutter style, by a developer. Sometimes even the quirkiest architectural detail can be used to create a fascinating focal point.

 

Natural light – A sunny, airy home feels happier and more spacious, but don’t automatically give up on a house because it is dark. Consider small changes that could bring in more light. We’ve added skylights, transom windows and even cut openings in walls and floors to help light spread throughout a home. Consult your contractor.

A Single Woman’s Guide To Home Ownership

Almost twice as many single women are purchasing homes than single men, and almost one in five homes purchased today are purchased by single women.

So why are single women making up such a large part of the housing market, and what are the special considerations single women should make when purchasing a home?

What Women Want

The demographics of single women buying homes are quite diverse. All ages, young professional women in their 20s-40’s, middle age professional women,  divorced mothers,  down sizers, and snow birds, there are really no TYPICAL single women making home purchases, each has a unique situation,  and their needs are just as diverse.

Based on my experience, there do appear to be a few trends in this market, and here is a list of what I see:

·        Spend less than $300,000 or trade up for more than $500K.

·       Consult an able mortgage adviser to determine best financial outcome.

·       Work from home, or are away from home a lot.

·       Travel for work or love vacations.

·       Homebodies and love to grow food and into alternative medicine.

·       Prefer two bedrooms or more

·       Prefer 1.5- 2 bathrooms

·       Prefer walk in closets

·       Try on 800-1500 Square Feet, for size

·       Evaluate the need for a garage

·       Less likely to choose new construction

·       Likely to avoid noise pollution from buildings that sit on a busy street

·       Prefer central a/c, especially if on a busy street

·       Chose energy audits and alternatives to electric heat

·       Will compromise size and cost to get other amenities, but not compromise location

·       Smaller spaces are acceptable, and many prefer condos

·       Desire security and safe neighborhoods with a strong community feel

·       Look for close proximity to walking trails, parks, stores, shopping, and fitness centers

When moving day arrives, there’s nothing quite like the nagging feeling that you’re forgetting something. Don’t leave anything behind!

A good rule of thumb is that the LAST things that you use,  are likely to be those that are forgotten, so make sure to do a final check through the house before leaving.

BUYER BEWARE

Buyer Beware

Most buyers are unaware that in Massachusetts, with a few exceptions, the rule of Buyer Beware is still alive and well.  That is why the vast majority of transactions, buyers choose to have the property inspected by a licensed home inspector.  And it is also why there is a contingency in the offer, giving the buyer the right to opt out of the agreement they are not satisfied, or if there are defects or serious issues cannot be overcome.

Caveat Emptor is an old common law rule which means “Buyer Beware”.  In plain English, it means that home buyers are on their own when it comes to the condition of a property. If there is a defect of any kind, it becomes the buyer’s problem, not the sellers.

Legally in Massachusetts, a private seller has no obligation to disclose anything to you about the home or nearby conditions. A seller can only get in trouble if he is asked a direct question and flat out lies about it.

Experts will tell you to use your tax refund to pay down some debt or to tuck away into your savings.

DECLUTTERING

ORGANIZATION EQUALS ACTION

 

Have you ever felt the strong desire to move forward with a project or situation, but couldn’t get going? Often this is because your external and internal worlds are cluttered.

 

De-cluttering your world can happen on many levels. The most obvious one that probably comes to mind for many is de-cluttering your environment. If your office has clutter or lacks organization and you have trouble moving forward with an idea or project, it might be time to take a time-out and develop a system of organization. Also, getting rid of things such as books, objects, decorations that no longer serve you or that you are not using anymore can be extremely cathartic. You know instinctively if something in your environment is bothering you or just feels like dead energy. Get rid of it! This may be true of your home as well or any other environment where you spend a lot of time. In addition, cleaning your environment is part of de-cluttering. Grime, filth and germs are a kind of clutter. They represent old energy that needs to be washed away. It’s hard to start afresh when you’re surrounded by old energy.

 

Often de-cluttering and organizing stay on the back burner because you just can’t find the time for it. One solution is to find 5-10 minutes per day to start the process. As you begin to see progress, you may be energized to put a bit more time into it. Also, if you can take part of a day off to tackle a large amount all at once, you’ll experience immediate relief and feel inspired by the results. In the world of Feng Shui, it is a known fact that a clean, clutter-free and organized environment creates a coherent energy. When you interact with that energy, you are less likely to be able to tolerate messes that lie next to the beautifully clean and organized area. This is a great Feng Shui phenomenon, since it then gives you the energy and inspiration to more rapidly move forward with the de-cluttering and organizing.

 

De-cluttering and organizing are also an inside job and sometimes we can’t even de-clutter our external environments because of internal clutter. What resides within your thought patterns and emotions that you need to let go of? Meditating and getting in touch with the blocks in your body can help bring awareness to the state of your internal world. You may need to express grief, anger or some other emotion. You may need to communicate something you’ve been holding on to for a long time. Perhaps you are spending time with friends who don’t serve your highest good and lower your energy.

 

If you can de-clutter your internal and external worlds, you will feel more energized and inspired to move forward with projects, plans, dreams and long-term goals.

FENG SHUI INTERIOR DESIGN

Feng Shui Interior Design

Just what is Feng Shui? The short answer is that it’s an ancient Chinese art and science that was developed some 3000 years ago to help people balance the energies in the places they lived. It’s pronounced Fung Shway and it translates to “Wind Water.” In Chinese culture, the elements play an important part in everyday life, as in wind and water that bring good harvests, which in turn bring good health and prosperity.

Feng Shui is based on Taoist philosophy, which puts a great deal of stock in living in harmony with nature, and states that land is alive and brimming with energy, or chi (pronounced chee). This in turn means that your home is alive and full of chi as well,  and needs to be arranged in such a way that the chi can be maximized.

DO-IT-YOURSELF INTERIOR PAINTING

Do-It-Yourself Interior Painting

Paint quality and technology has come a long way, particularly since it is the most sought after wall covering. It can be more than $50 a gallon for premium paints and if you have ever painted with bargain paints,  you will appreciate the coverage and flow.

Ask them about their most popular colors and about their home decorator paint color consultation. There is a charge, but most of it is rebated back to you, for paint purchases.

To estimate how much paint you’ll need, multiply the perimeter of the room by the height of the walls, which will give you the square footage of your room. For ceilings, simply multiply the length by the width. A gallon of paint typically covers 350-450 square feet. You’ll want to overestimate a bit to account for later touch-ups. Common knowledge advice is to start painting at the top,  and work your way down – ceiling, walls, trim. I actually like to paint trim first,  cut in walls and then roll the walls last.

BUILD HOME EQUITY FASTER

Build Home Equity Faster

Equity is the part of your property that you actually own.

If you own property that’s worth $250,000, and you have a mortgage with a remaining loan balance of $100,000, your equity in the property is $150,000. Repeat home buyers usually rely to some extent on the equity in their current home to help buy their next home. The more equity you have, the larger the possible down payment for the trade-up home.

Home equity also equals security. Especially at the beginning of a mortgage loan, so little of your payment goes to principal that equity builds maddeningly slowly.

Naturally, building home equity comes at a price, usually in the form of larger payments. If building home equity means incurring debt to make ends meet, then you’ve defeated the purpose of building equity in the first place.

One way is to make additional principal payments. Additional principal payments make sense when you save more on your mortgage interest expense on an after-tax basis than you would earn on your investments on an after-tax basis. If you are able to deduct your mortgage interest from your income taxes and your marginal federal income tax rate is 27 percent or higher, then your after-tax cost of mortgage debt is between 3 and 4 percent.

For instance, if you earn 4 percent pretax on a five-year CD, and you’re in the 27-percent bracket for federal income taxes, the after-tax return is less than 3 percent.

Before you start making additional principal payments, use one of the many amortization calculators you can find on the internet to do the math—how much interest you would save if you made additional principal payments, and how much it would shorten your loan and increase your home equity.

Ask your lender about setting up bi-weekly mortgage payments.

The other way to build home equity faster is to refinance. Recently, the reason most people have refinanced is to lock in a lower interest rate and/or lower their monthly payment. But you can also refinance to shorten the term of your mortgage, which builds equity.

If you had a $200,000 30-year ARM at 8.13 percent and replaced it with a 15-year fixed rate loan at 6.75 percent, your monthly payment would go from $1485.69 to $1769.82.

Most sellers use part of their equity to pay selling costs, such as brokerage commissions and transfer taxes. Also, if you are delinquent on your property taxes, or have other liens secured against the property, such as an IRS tax lien, these would have to be paid at closing.
